Terms of Service

Definitions
  • If you (the Subscriber) choose to use the haydenplanetarium.org (the Service), or any of its features, you will be agreeing to abide by all of the terms and conditions in this Agreement between you and the Hayden Planetarium on the web, an internet service of the American Museum of Natural History (AMNH).
  • If you deem the Agreement unacceptable, you may cancel your membership by sending e-mail to planetarium at haydenplanetarium.org.
Change of terms
  • AMNH shall have the right at any time to modify the terms of the Agreement.
  • The terms of this agreement shall become effective immediately upon posting. You are responsible for reviewing the Agreement each time you use the Service.
Content
  • The contents of the Service are intended for your personal, noncommercial use. All materials published as part of the Service are protected by copyright and owned by the AMNH or the party credited as the provider of the content.
  • You acknowledge the comments posted on the Service do not represent the views or opinions of AMNH or any of its employees.
  • The Service and its contents are protected by copyright pursuant to U.S. and international copyright laws. You may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create new works from, distribute, perform, display, or in any way exploit, any of the content or the Service in whole or in part, except where noted otherwise.
  • By submitting Content to the Service, the Subscriber automatically grants AMNH perpetual, royalty-free, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, and distribute such material in whole or in part as part of, but not limited to, the Service.
Subscriber Conduct
  • The Subscriber shall not upload to, or distribute or otherwise publish on to the Service any copyright-protected, libelous, defamatory, obscene, pornographic, or abusive content, nor shall the Subscriber publish content that gives rise to civil liability, violates any law, or contains advertising or solicitation materials.
  • The Service reserves the right, but shall have no obligation, to pre-screen, review, filter, modify, refuse, or remove any or all content from any Service. If you place commercial ads in the form of links unrelated to the subject of a post, your comments will be deleted and, at our discretion, your account and all your content at haydenplanetarium.org will be deleted.
  • While AMNH will make every attempt to keep offensive content off the Service, you understand that by using the Services you may be exposed to content that you may find offensive, indecent or objectionable and that, in this respect, you use the Services at your own risk.
  • Offensive speech of any kind, whether it be abuse or discrimination on the basis of race, gender, nationality, sexual preference, religion, disability, or other hate speech is grounds for immediate and permanent suspension of your membership to the Service.
  • You agree not to access (or attempt to access) the Service through any automated means including, but not limited to, the use of scripts or web crawlers.
  • You agree that you will not engage in activities that disrupt or interfere with the Service.
Passwords and Account Security
  • You are responsible for maintaining the confidentiality of your password you use with the Service.
  • You agree that you are responsible to AMNH for all activities that occur under your account.
  • If you become aware of any unauthorized use of your account or your password, you shall notify AMNH immediately at planetarium at haydenplanetarium.org.
Disclaimer of Warranty and Liability
  • THE SERVICE AND ALL DOWNLOADABLE SOFTWARE ARE DISTRIBUTED ON AN AS IS BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. YOU HEREBY ACKNOWLEDGE THAT USE OF THE SERVICE IS AT YOUR SOLE RISK.
  • AMNH, its Officers, and Employees shall not be held liable in the event of damages or injury caused by any failure of performance, interruption, error, omission, defect, delay in operation or transmission, computer virus, or under any other cause of action to the Service. Furthermore,
  • By using the Service, you agree to indemnify, defend and hold harmless AMNH from and against any actual or alleged claims, demands, causes of action, judgments, damages, losses, liabilities, and all costs and expenses of defense (including, without limitation, reasonable attorneys' and other legal fees and costs) arising out of or relating to: (1) your violation of these terms of use or any law, rule or regulation; (2) a claim that is based on your use of any content on the Service; or (3) any material uploaded by you or through your computer to our blog, forum, or otherwise sent by you to AMNH. You will cooperate as fully and reasonably as required by the AMNH in the defense of any claim. Museum reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you will not in any event settle any claim without the prior written consent of the AMNH.
  • These terms of use have been made in and shall be construed and enforced in accordance with New York law. Any action to enforce this agreement shall be brought in the federal or state courts located in New York City.
